Distance Sales Contract

 

Section 1 - Subject

This preliminary information form covers the rights and obligations related to the sale and delivery of products between the BUYER and the SELLER in accordance with the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts. By approving this form, the BUYER agrees to pay the total amount including the product price, shipping cost, and all applicable taxes in the event of placing an order.

Section 4 - Product Details

The essential characteristics of the products offered for sale are published on the SELLER’s website. All prices listed on the website are inclusive of taxes and valid unless otherwise stated. Discounted prices available for a limited time apply only for the specified duration.

Details of the products ordered by the BUYER are as follows: Product Description | Quantity | Unit Price

Shipping Cost: The shipping fee will be borne by the BUYER and added to the total order amount, invoiced accordingly.

Section 5 – General Terms

Subtotal (including VAT): The total amount of the order includes the product price, shipping cost, and all taxes. The BUYER agrees to pay this amount upon confirming the order.

The BUYER declares that they have read, understood, and accepted all the pre-sale information about the product features, sales price, payment methods, and delivery conditions provided on the SELLER’s website.

The product(s) will be delivered to the delivery address specified by the BUYER or the person designated by them, within the time stated in the preliminary information and depending on the distance. The delivery period shall not exceed the legal limit of 30 days. If the delivery is not made within this period, the BUYER has the right to terminate the contract.

Although the SELLER makes every effort to keep stock updated, products may run out. In such cases, the SELLER will inform the BUYER as soon as possible.

The SELLER is obliged to deliver the ordered product completely, in accordance with the specifications indicated in the order. If necessary, the SELLER may supply a product of the same quality and price upon obtaining the BUYER’s approval.

If delivery becomes impossible, the SELLER will inform the BUYER within 3 days and refund the collected amount within 14 days.

In case the payment is not completed or is cancelled by the bank, the SELLER is released from the delivery obligation.

If the product is delivered and payment is not received by the SELLER due to unauthorized use of a credit card, the BUYER must return the product within 3 days. Return shipping costs will be covered by the SELLER.

In the event of force majeure (such as natural disasters, pandemics, wars, transportation disruptions, etc.) that delay delivery, the SELLER will promptly notify the BUYER. The BUYER may choose to:

• Cancel the order,
• Request a replacement product,
• Postpone delivery until the force majeure ends.

If the order is cancelled:

• For cash payments, the amount will be refunded within 14 days.
• For credit card payments, the refund will be processed to the bank within 14 days. The BUYER acknowledges that the bank may reflect the amount in their account within 2–3 weeks and that this process is beyond the SELLER’s control.
• The SELLER may contact the BUYER using the communication details provided in the contract regarding the order process.

The BUYER is responsible for inspecting the product before accepting delivery. Products with damaged packaging, defects, or incorrect items should not be accepted. Accepted products are considered complete and undamaged. If the right of withdrawal is to be exercised, the product must not be used and must be returned with its invoice.

Sales made on this website are for retail purposes. The SELLER reserves the right to cancel orders and withhold delivery if it suspects the products are being purchased for resale purposes.

Invoice Delivery: The invoice will be delivered to the billing address together with the order.

Section 7 – Right of Withdrawal

The BUYER has the right to withdraw from the contract within 14 days from the delivery date, without giving any reason or incurring any penalties.

The return shipping cost related to the use of the right of withdrawal will be covered by the SELLER. By confirming this contract, the BUYER acknowledges being informed about the right of withdrawal.

Upon receipt of the withdrawal notice, the SELLER will refund the full product price to the BUYER within 14 days.

After notifying the SELLER in writing about exercising the right of withdrawal, the BUYER is obliged to return the product within 10 days in its original packaging and with all accompanying parts.

If the returned product was invoiced to a legal entity, a return invoice must be issued and included with the return. Returns without an accompanying return invoice will not be accepted.

Section 8 – Exceptions to the Right of Withdrawal

The BUYER cannot exercise the right of withdrawal for the following:

• Products and services whose prices fluctuate based on financial market conditions beyond the SELLER’s control,
• Products made to the BUYER’s specifications or clearly personalized,
• Perishable or expired goods,
• Products not suitable for return due to health or hygiene reasons if the packaging or seal has been opened (e.g., earrings, underwear),
• Goods that become inseparably mixed with other items after delivery,
• Books, digital content, or computer consumables whose packaging has been unsealed,
• Periodicals such as newspapers or magazines (excluding subscription contracts),
• Accommodation, transportation, car rental, catering, or leisure services to be provided on a specific date or period,
• Services performed instantly in electronic format or digital goods delivered immediately,
• Services that have begun with the BUYER’s consent before the withdrawal period expires.

Section 9 – Dispute Resolution

The BUYER may submit any complaints or disputes regarding the purchased product or service to the Consumer Arbitration Committee or Consumer Court located in their place of residence or where the purchase was made.
